Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the CloudiKids mobile application, CloudiKids devices, websites, artificial intelligence features, content-generation services, and related products and services (collectively, the “Services”).
The Services are provided by BTL Diffusion, located at 14 Chemin des Vaux, 78490 Galluis, France (“CloudiKids,” “we,” “us,” or “our”).
Please read these Terms carefully. By creating a CloudiKids account, purchasing or activating a subscription, connecting a CloudiKids device, or otherwise using the Services, you agree to these Terms.
These Terms of Service (the “Terms”) govern your access to and use of the Services. By visiting, interacting with, or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.
1. Parent and Guardian Accounts
The CloudiKids app is intended for use by parents, legal guardians, and other authorized adults only.
You must be at least 18 years old, or have otherwise reached the age of legal majority in your jurisdiction, to create a CloudiKids account and agree to these Terms.
Children are not permitted to create CloudiKids accounts or independently use the CloudiKids mobile application.
If you create a child profile, connect a CloudiKids device for a child, or provide information relating to a child, you represent that you are the child’s parent or legal guardian or otherwise have the legal authority to provide that information and use the Services on the child’s behalf.
The account holder is responsible for all activity conducted through the account and for appropriately supervising a child’s use of any child-facing CloudiKids device or feature.
2. Child Profiles
CloudiKids allows parents and guardians to create and manage profiles for children.
Depending on the features you choose to use, you may provide information relating to your child, such as:

First name or Nickname;

Pronouns;
-
Personality traits and interests;
-
Birthday;
-
Age range
This information is provided to CloudiKids by you as the parent or guardian. The CloudiKids mobile app is not designed to request that children independently provide personal information through the app.
You are responsible for ensuring that you have the authority to provide information relating to a child.
Information relating to children will be processed in accordance with our Privacy Policy.
3. Children’s Privacy
CloudiKids is designed with children’s privacy in mind, even though the CloudiKids mobile app is intended to be operated by parents and guardians rather than children.
Through the app, we may process information about a child that is provided by the parent or guardian for purposes such as creating a child profile, selecting age-appropriate content, personalizing stories, creating characters, managing a CloudiKids device, or providing other requested features.
We do not permit children under 13 to create an account or independently submit personal information through the CloudiKids mobile app.
4. Parent Control of Child Profile Information
Parents and guardians can use available account controls to review, update, or delete certain information associated with a child profile.
You may also request access to, correction of, or deletion of personal information relating to your child by contacting us at contact@mycloudikids.com.
We may take reasonable steps to verify your identity and, where appropriate, your authority to act on behalf of the child before fulfilling a request.
Deletion of certain information may affect personalized functionality or require deletion of the applicable child profile.
Where applicable law provides additional rights to a child or other data subject, we will honor those rights as required by law.
5. European Data Protection
The CloudiKids mobile app is offered to parents and guardians and is not intended to be an information society service offered directly to children.
Personal data relating to children may nevertheless be processed when a parent or guardian creates or manages a child profile or uses other CloudiKids features on behalf of a child.
We will rely on an appropriate legal basis for each processing activity as described in our Privacy Policy.
Where consent is required for an optional processing activity, we will request consent separately from these Terms from the person legally authorized to provide it.
Acceptance of these Terms does not constitute blanket consent to all processing of personal data.
Subject to applicable law, individuals may have rights relating to their personal data, including rights of access, correction, deletion, restriction, objection, portability, and withdrawal of consent.

6. Artificial Intelligence Features
CloudiKids uses artificial intelligence to provide features that may include generating:

fictional stories;
-
educational stories or lessons;
-
questions and answers;
-
songs or other audio content;
-
avatars;
Collectively, these materials are referred to as “AI Content.”
Artificial intelligence systems are probabilistic. AI Content may occasionally be inaccurate, incomplete, repetitive, unexpected, or inappropriate despite our safeguards.
Parents should exercise appropriate supervision and should not rely on AI Content as an authoritative source where accuracy or safety is important.
7. Child Safety and Content Safeguards
CloudiKids is designed to provide experiences appropriate for children.
We may use automated moderation, safety classifiers, prompt filtering, age-related content controls, restricted-topic lists, human review where appropriate, or other safeguards.
CloudiKids may block, reject, modify, or safely rewrite requests that may involve:

sexual or adult content;
-
graphic violence;
-
self-harm;
-
dangerous activities;
-
illegal conduct;
-
hate, harassment, or abuse;
-
exploitation of children;
-
disclosure of sensitive personal information;
-
infringement of intellectual property;
-
attempts to circumvent safety systems; or
-
other content we reasonably determine is inappropriate for the Services.
No automated safety system is perfect. CloudiKids does not guarantee that all generated content will always be appropriate for every child.
Parents and guardians remain responsible for determining whether particular content is appropriate for their child.
Content that appears unsafe or inappropriate may be reported through contact@mycloudikids.com.
8. AI Training and Children’s Information
CloudiKids will not use personal information collected directly from a child to train or develop general-purpose artificial intelligence models, or permit an independent third party to use such information for its own AI-model training or development, unless that practice is specifically disclosed and all legally required authorizations and consents have first been obtained.
9. Advertising and Commercial Use of Children’s Data
CloudiKids does not use children’s personal information for behaviorally targeted advertising.
CloudiKids does not sell children’s personal information for advertising purposes.
If CloudiKids introduces a practice that involves disclosure of personal information collected directly from children to third parties for advertising or another non-integral purpose, we will provide any notices and obtain any separate parental consent required by applicable law before implementing that practice.
10. Data Minimization and Retention
CloudiKids seeks to collect and process only information reasonably necessary to provide and maintain the Services and for other purposes described in our Privacy Policy.
Personal information will be retained only for as long as reasonably necessary for the purposes for which it was collected, subject to applicable legal, security, accounting, dispute-resolution, and regulatory requirements.
Children’s personal information will not be retained longer than reasonably necessary for the purposes for which it was collected.
Additional information regarding retention periods or the criteria used to determine those periods is provided in our Privacy Policy.
11. Your Inputs
Parents may provide prompts, story ideas, profile information, character descriptions, interests, preferences, photographs, or other information through the Services (“Inputs”).
You retain any rights you may have in your Inputs.
You grant CloudiKids a limited, non-exclusive, worldwide license to host, reproduce, process, transmit, and otherwise use Inputs only as reasonably necessary to operate, secure, maintain, personalize, and provide the Services, subject to our Privacy Policy and applicable law.
This license does not authorize CloudiKids to use children’s personal information for unrelated behavioral advertising or independent AI-model training contrary to these Terms.
You represent that you have the rights and permissions necessary to submit the Inputs you provide.
12. Copyright, Trademarks, and Third-Party Content
You may not knowingly use CloudiKids to infringe another person’s copyright, trademark, privacy right, publicity right, or other intellectual-property right.
CloudiKids may restrict or reject prompts involving copyrighted characters, brands, celebrities, trademarked properties, or other protected material where we determine that doing so is appropriate.
Generation of an image, story, or other output does not grant you ownership of any intellectual-property rights belonging to another person.
CloudiKids may remove or restrict content in response to valid intellectual-property complaints or where required by law.
13. CloudiKids Devices
Some Services require a compatible CloudiKids device.
You are responsible for using the device in accordance with applicable instructions, safety information, and documentation.
Connecting, removing, resetting, updating, or transferring content to a device may affect locally stored settings or content.
Certain features may require Bluetooth, Wi-Fi or internet connectivity, device permissions, compatible mobile hardware, or other technologies.
CloudiKids may provide software or firmware updates to improve functionality, security, compatibility, safety, or reliability. Certain updates may be required for continued use of some Services.
14. Account and Device Security
You are responsible for maintaining the confidentiality of your account credentials.
You must not allow an unauthorized person to access or manage your CloudiKids account.
If you believe that your account credentials or a connected device have been compromised, you should notify us promptly at contact@mycloudikids.com.
You are responsible for managing the child profiles and devices connected to your account.
15. Cloud Coins
CloudiKids may offer virtual credits known as “Cloud Coins.”
Cloud Coins may be received through subscriptions, promotional offers, purchases, welcome benefits, or other methods disclosed within the Services.
Unless otherwise required by applicable law:

Cloud Coins have no cash value;

Cloud Coins are not legal tender;
-
Cloud Coins may be used only for eligible CloudiKids content or features;
-
Cloud Coins may not be transferred between unrelated accounts; and
-
Cloud Coins cannot be redeemed for cash.
Different types of Cloud Coins may be subject to different usage, expiration, or refund rules. Material conditions will be disclosed at or before acquisition or purchase.
CloudiKids may change the number of Cloud Coins required for future transactions. Such changes will not retroactively change a completed transaction.
Nothing in this section limits rights that cannot be waived under applicable consumer law.
16. Purchases and Subscriptions
CloudiKids may offer free services, subscriptions, one-time purchases, or other paid features.
Before you complete a purchase, we will display applicable pricing, billing frequency, and material purchase or subscription conditions.
If you purchase an automatically renewing subscription, your subscription will renew at the disclosed billing interval until cancelled.
Depending on where you purchased the subscription, cancellation may need to be completed through:

Apple App Store;
-
Google Play;
-
another payment platform identified at the time of purchase.
Cancellation generally stops future renewal and does not automatically provide a refund for a billing period already begun, except where required by law or applicable marketplace rules.
Purchases processed through Apple, Google, or another third-party marketplace may also be subject to that provider’s terms, billing requirements, and refund procedures.
17. EU/EEA Consumer Rights
If you are a consumer residing in the European Union or European Economic Area, nothing in these Terms limits or excludes mandatory consumer rights available to you under applicable EU or national law.
Where applicable, you may have statutory rights concerning digital services or digital content, conformity, remedies, termination, withdrawal, or refunds.
Any limitation of liability, governing-law provision, dispute-resolution provision, or other restriction contained in these Terms applies only to the extent permitted by applicable law.
18. Acceptable Use
You may not use or attempt to use the Services to:

violate applicable law;
-
harm, exploit, or endanger a child or another person;
-
create or distribute unlawful material;
-
compromise or bypass security protections;
-
bypass parental controls or content-safety systems;
-
interfere with CloudiKids systems or infrastructure;
-
introduce malware or malicious code;
-
access another person’s account without authorization;
-
systematically scrape or extract content or data;
-
reverse engineer the Services except to the extent expressly permitted by applicable law;
-
infringe another person’s intellectual-property or privacy rights; or
-
use the Services in a manner that materially interferes with other users or CloudiKids operations.
We may take reasonable measures to detect, prevent, and investigate suspected misuse.
19. Service Availability and Changes
CloudiKids may periodically add, modify, improve, replace, or discontinue features.
The Services may occasionally be unavailable because of maintenance, technical problems, security incidents, infrastructure failures, legal requirements, or circumstances outside our reasonable control.
20. Suspension and Termination
You may stop using the Services at any time.
You may request account deletion through Account Settings.
We may restrict, suspend, or terminate access where reasonably necessary because of:

a serious or repeated violation of these Terms;

fraud or unauthorized activity;
-
a security threat;
-
unlawful activity;
-
conduct presenting a risk to children or other users;
-
legal or regulatory requirements; or
-
discontinuation of relevant Services.
Where appropriate and required by applicable law, we will provide reasonable notice before termination.
Termination does not eliminate rights or obligations that by their nature survive termination.
Personal information following account termination will be handled in accordance with our Privacy Policy, retention requirements, and applicable law.
21. Third-Party Services and Service Providers
CloudiKids may rely on third-party providers for functions such as:

cloud hosting;
-
text-to-speech processing;
-
avatar or image generation;
-
content moderation;
-
payment processing;
-
customer support;
-
security; and
-
other technical infrastructure.
Where a provider processes personal information on our behalf, we will require appropriate contractual and data-protection safeguards consistent with its role and applicable law.
Certain third-party services that you independently access may be governed by their own terms and privacy policies.
22. Educational and Informational Content
CloudiKids may provide AI-generated educational explanations, stories, questions, facts, or similar materials.
AI-generated information may contain errors or outdated information.
CloudiKids does not provide medical, psychological, legal, financial, emergency, or other professional advice.
Parents should independently verify information where accuracy is important and should seek an appropriate professional where professional advice is required.
23. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the Services are provided “as is” and “as available.”
We do not warrant that the Services will always be uninterrupted, error-free, secure, or available.
We do not guarantee that AI Content will always be accurate, complete, unique, suitable, age-appropriate, or free from errors.
Nothing in these Terms excludes or limits warranties or consumer rights that cannot legally be excluded or limited.
